Many small businesses in Maine are formed as Limited Liability Companies (“LLCs”). In Maine, a closely-held limited liability company is defined as an LLC with fewer than 35 members, which has no transferable interests listed on a national securities exchange or regularly quoted in an over-the-counter market by one or more members of a national securities association.
During a divorce, when property, including businesses, need to be distributed or when Child Support needs to be calculated, and one of the parties is an owner of a small or closely-held business, it can often be difficult for the parties or the Court to determine the value of the business.

A forensic accountant may be asked to provide you with the valuation of the business, as well as the annual income of the owner.
These forensic accountants will be designed for the Court as one of your “Expert Witnesses.” An Expert Witness is someone who has certain knowledge, skills, education, experience, or training in a specialized field, which allows them to testify as to their independent expert opinion at trial based on the information that is provided to them.
